These Terms of Use (the "Terms") are between you, the user of the Jsmon platform (as defined below), and Jsmon Inc. ("Jsmon", "we", "us", or "our"). The Terms enter into force upon your acceptance — such as when you create an account, access your account for the first time, or otherwise access and use our Services (as defined below). These Terms continue in full force for as long as you are using our Services, unless terminated as set forth herein.

1. Acceptance of Terms
By accessing, subscribing to, or using Jsmon's Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
2. Eligibility
You must be at least 18 years old or of legal age in your jurisdiction to enter into these Terms and use our Services. By using our platform, you represent and warrant that you meet these requirements. If you are using the Services on behalf of an organization, you further represent that you have the authority to bind that organization to these Terms.
3. Account Registration and Security
To access certain features of the platform, you are required to register for an account. The following conditions apply:
Account Creation: You agree to provide accurate, complete, and up-to-date information during registration and to keep such information current at all times.
Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens, and for all activities that occur under your account.
Unauthorized Access: You must notify us immediately at support@jsmon.sh if you suspect any unauthorized access to or use of your account.
4. Acceptable Use
Jsmon is an AI-powered External Attack Surface Management (EASM) platform. You must only use Jsmon to monitor, scan, and manage assets that you own or for which you have explicit written authorization from the asset owner.
You agree that you will not:
Use the Services to scan, probe, or monitor systems, domains, or assets that you do not own or are not authorized to test
Use the Services for any unlawful purpose or in violation of any applicable local, national, or international law or regulation
Attempt to reverse-engineer, decompile, disassemble, modify, or create derivative works of the platform or its underlying technology
Access the platform in a manner that disrupts, degrades, or impairs its functionality, security, or availability
Resell, sublicense, or otherwise make the Services available to third parties without our prior written consent
Upload or process data through the Services that you do not have the legal right to use
Attempt to extract, reconstruct, or disclose any proprietary system prompts, AI model configurations, agent instructions, or internal policies used by Jsmon's AI-powered features, whether via prompt injection or any other means
We reserve the right to suspend or terminate access immediately for any abuse, violation, or suspected unlawful activity.
5. License to Use Services
Grant of License: Subject to your compliance with these Terms, Jsmon grants you a limited, non-exclusive, non-transferable, revocable license to access and use our SaaS platform solely for your internal security operations and attack surface management purposes.
Restrictions: This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit or make available to any third party the Services or any part thereof.
6. Payment and Subscription
Fees: Certain features of the Services require a paid subscription. All applicable fees are disclosed during the sign-up process and on our pricing page at jsmon.sh.
Billing: Payments are processed through Stripe, our secure third-party payment provider. You agree to provide accurate and complete payment information and authorize Jsmon to charge applicable fees to your payment method.
Renewals and Cancellations: Subscriptions renew automatically at the end of each billing cycle unless canceled prior to renewal. You may cancel your subscription at any time through your account settings or by contacting support@jsmon.sh. No refunds are issued for partial billing periods unless otherwise required by applicable law.
Taxes: You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities in connection with your use of the Services.
7. Proprietary Rights
All intellectual property rights in and to the Jsmon platform — including but not limited to the software, codebase, design, user interface, AI models, scan logic, detection algorithms, documentation, and underlying technology — are owned by Jsmon Inc. or its licensors. Nothing in these Terms transfers any intellectual property rights to you.
You retain all rights to the data and assets you provide to or configure within the platform ("Customer Data"). You grant Jsmon a limited license to process and use your Customer Data solely for the purpose of providing the Services to you.
You agree not to remove, obscure, or alter any proprietary notices, labels, or marks on or within the Services.
8. AI-Generated Outputs
Jsmon uses artificial intelligence and automated tooling to generate scan results, findings, asset inventories, risk indicators, and other outputs (collectively, "Outputs"). Outputs are provided for informational and operational security purposes only.
While we strive for accuracy and quality, Outputs are provided "as is" and may require human review before being acted upon. You are solely responsible for how you use, interpret, and act on any Outputs generated by the platform, including any responsible disclosure obligations to third-party vendors.
9. Data Privacy and Security
Privacy Policy: Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Customer Data: We will maintain the confidentiality and security of your Customer Data in accordance with industry-standard practices and our Privacy Policy.
Data Responsibility: You are responsible for ensuring that any data you upload, configure, or process through the Services is lawfully obtained and that your use of it complies with all applicable laws and regulations.
10. Service Availability
We strive to ensure reliable, uninterrupted access to the Jsmon platform but do not guarantee availability at all times. Scheduled maintenance, infrastructure upgrades, or unforeseen technical outages may temporarily impact access. We will make reasonable efforts to provide advance notice of planned maintenance.
11. Termination
By You: You may terminate your account at any time by contacting support@jsmon.sh or through your account settings.
By Us: We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for violation of these Terms, non-payment of applicable fees, or for any other reason at our reasonable discretion.
Effect of Termination: Upon termination, your license to use the Services will immediately cease and your access will be revoked. Customer Data may be retained for a limited period and then deleted in accordance with our data retention policy. Sections 4, 7, 8, 12, 13, and 14 survive termination.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. JSMON DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JSMON INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF JSMON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL JSMON'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS EXCEED THE TOTAL FEES PAID BY YOU TO JSMON IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Jsmon Inc., its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your scanning or monitoring of systems without proper authorization.
15. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be communicated via email or through a notice on our platform. Continued use of the Services after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Services.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. For users accessing the Services from India, matters relating to the Indian subsidiary (Jsmon Private Limited) may additionally be subject to the laws of India.
17. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, breach, or termination thereof, shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may seek resolution through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English, with the seat of arbitration in Delaware, United States. The decision of the arbitrator shall be final and binding. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
